Dear Genewitch... It is not against the law in California to photograph children in public places against their will or that of their parents. I don't agree that strangers need to be doing this and as a parent it worries me but unless the law is changed strangers can keep taking those pictures.

ANY PERSON who is in a public place can be photographed by any other person, it's constitutionally protected free speech sez the SCOTUS! If a father does not like his kids being photographed he needs to take them to another place. I cannot abridge another person's constitutional rights just because my kids are involved.

Oddly enough, I've been able to turn this particular protective impulse to my advantage:

A couple of kids broke glass (a bottle?) in my driveway; I grabbed a Walkman (this was years ago) and pretended to snap their pictures with it.

As I'd hoped, they returned with their father shortly thereafter wanting to know why I took their pictures. I explained the ruse and asked the father if they would clean up the glass. They all did so.

Hmmmm, doing things that other people don't like. Sounds like disorderly conduct to me!
