A BART police officer was caught on video pushing a suspect’s head to the ground before standing up, pulling his gun out of its holster and squeezing the trigger, killing the 22-year-old suspect instantly.
The incident occurred New Year’s Day inside a Bay Area Rapid Transit station in Oakland.
Seconds before the shooting, the unarmed victim, Oscar Grant III, can been seen on his knees lifting his hands in the air as if to show he was not resisting arrest. But at least two officers dragged him down as if to handcuff him, forcing the suspect’s chest and face on the ground.
That was when one officer stood up, pulled his gun out and shot him, possibly in the back or in the back of the head. After the shooting, the officer re-holstered his gun and placed his hands on his head, as if realizing what he had just done.

The officer, whose name is Johannes Mehserle, just turned 27 years old and is a two-year veteran of the police force, according to the San Francisco Chronicle. His first child was born a day or two after the shooting, which may be a reason he still hasn’t given a statement to police as to what happened that night.
Five days have passed since a BART police officer shot and killed an unarmed rider on a station platform, but the officer has not given a statement to investigators about what happened and the transit agency has apparently not forced him to do so.
John Burris, an Oakland attorney representing the family, says he plans to file a $25 million lawsuit against BART.
Burris, who has represented clients in more than a dozen officer-involved shootings, said he had never seen such a long delay before an officer makes a statement to investigators. He said it raises the possibility that the statement could be affected by the video footage and by loss of memory, among other things.
“It’s pretty shocking to me,” Burris said. “When you delay like this, it raises questions about the integrity of the investigation. It raises the question, ‘What has BART been doing?’ You want to prevent collusion. You want to prevent people from tailoring their statements to the evidence.”
This incident once again proves the importance of citizens being allowed to film and photograph freely without intimidation or fear from authorities.

Another questionable arising is the fact that BART police have “confiscated numerous cell phone images” from witnesses, supposedly for evidence, according to Fox News.
BART police officers are fully certified and have the same authority as city or county law enforcement officers. They are in charge of enforcing the law on the Bay Area Rapid Transit, which is the fifth busiest rail system in the country and serves four counties in the San Francisco bay area.

Many people have said, “Hey, one less gangbanger!” or “If you don’t act up, you won’t get shot.”
Let’s pretend for a minute that punishments should fit the crime. Resisting arrest isn’t a crime that is or should be punishable by death. An unarmed man with his face to the fucking floor isn’t exactly the most major threat to an officer’s life.

This was a major screw-up. And I think he realized it as soon as it happened.
But you can see him deliberately stand up and reach into his holster, so he can’t even say the gun went off in the struggle, as I’m sure he would if it wasn’t so blatantly caught on video.

I’ve never held a taser but I’ve held a gun many times because I own two, and I can’t imagine confusing a gun for anything else in the world.

I was a cop in the late 60,s early 70,s and can say there is no excuse. When you have half the power of god you control your self and do not lose your “cool” . NO EXCUSE , this is, at best, manslaughter.

I did not know Oscar, but he was a frequent guest at my neighbors, Seeing the husky young man and the tall thin one with longer hair and knowing that I know them, their mom, their sisters and other family make me feel so angry to know that these two young men have to live with the shock and horror of witnessing a execution of Oscar. I recall seeing a Time magazine with a soldier executing a Vietnamese man and compare that execution with the death of Oscar. The mafia would be proud of Officer Mehserle, have no doubt that with the amount of racial slurs, threats, and other verbal abuse by the BART POLICE toward the passengers all returning from New Years Celebrations in San Francisco only to witness a murder infront of them. To add more fuel to the fire the Police Officers, in an attempt to conceal the murder confiscated as many of the cell phones that recorded the felony, not realizing that other video existed. BART initially told the media that the Camera’s did not have recording technology then recanted and claimed the video they have was not conclusive. This is the second time I know of in the past 1o years give or take a few years that BART PD has shot a unarmed man in the back. Now the Chief of Police (Gary Gee) refuses to interview or investigate his own officer whom should have been questioned immediatly after the shooting, First was he was in shock, then it was the birth of his first child, now it was because of his 27th birthday. JUSTICE DELAYED IS JUSICE DENIED. Someone contact Reverend Jessie Jackson and Reverend Al Sharpton to bring this murder to the attention of the entire USA. This cannot happen ever again. These young men were not armed and are clearly cooperating with the Officer and one was murdered in cold blood for it. My prayers are with his mother and family, his child and mother of his child. Anyone and everyone with information please give it to the attorney for Oscar’s family.

Thanks for writing. It’s really appalling how they could confiscate phones from the passengers.
I don’t know why anybody is not raising hell over that matter because that’s tampering with evidence.
If I had been there, there is no way in hell I would have given up my camera. They would have had to shoot me as well.

if they have a video of a suspect drawing a weapon and brandishing it at an officer, and the officer reacts with non-lethal or even lethal force, the “investigation” is considered closed.

I have never even joined the discussion on my own videos because the commenters are so filled with ignornace.
And it is also true that sometimes sarcasm can go over people’s heads on the internet, especially between people who have never met each other.

However, it would have helped if you would have used actual quotes in your comments to differentiate between what you were saying and what you were quoting other people as saying.
But having said all that, I really don’t even see the need to repost ignorant comments from other sites on this site.

OK junior. Let me clue you in. I LIVED in Oakland and rode BART to and from work for TWO YEARS. I’ve gotten off on the Fruitvale station as my condo was close by. I know that part of town intimately. When I moved out there from the Midwest it was the only place I could afford.
I was shocked that the Black Panther museum is located in Oakland or that on public access TV you regularly see black people calling people “whitey” and “crackers” and preaching racial hatred. Don’t lecture me on a neighborhood you know nothing about.
The first six paragraphs you used mentioned nothing about race. YOU ASSUMED IT EVERY TIME.

Obviously, getting into a non-lethal altercation shouldn’t warrant a death penalty. However, the cops would not had to have been there in the first place if his group and the other group hadn’t started a fight on public transportation. It’s not a gladiator arena for Christ’s sakes.

If you are white, thank God you willl never have to do what I and millions of Black mothers have to do to prepare our sons for encounters with law enforcement—give him tips that you hope will save their lives. When my son began driving I told him that if he is ever stopped by cops, esepcially on a dark road, and they begin insulting him or calling him racial slurs, he is to say nothing, especially about his “rights”, because cops have “law and order” attached to their hips and do not hesitate to dispense it to young black men. I told him that I would file a complaint about any abusuve teartement, at a later point, durng the daytime, with a witness, and that at least he would be alive. What happened to Oscar Grant is the nightmare that every mother of color with a son dreads if her son encounters cops. Anyone, except for the most rabid racist, can see on the video that Oscar had his hands up, before he was executed. The raised hands are the universal sign of surrender and “I am unarmed.” A few bloggers on other sites who state they were witnesses said that Oscar took a photo with his phone of one of the cops smashing a “suspect’s” head on the ground and THAT is when Merhles (sp?) went after Oscar. (Admitttedly, taking the photo was not the best thing to do…fatal in fact.) How eerily ironic that Merhles would take a life, so close to the time that his girlfriend was bringing life into the world. My son is in college studying to be a cop. He watched the video. He called me, shaken up. He asked a question that I could not answer, maybe his teacher can: “How can cops expect the public to trust and respect us, when you have a cop do something like that?”

I’ve seen the videos and it doesn’t seem like an “honest mistake” on the part of the cop, Johannes Mehserle. It looks to me as though Mehserle (only 2 years on the force) snapped under pressure. Maybe he just couldn’t deal with the stress of what was going on, reached for his gun in anger, shot the poor guy, and then realized what he did.
Well, it’s too late for an “I’m sorry.” Among other things, I’d like to know how this guy did on his psychological evaluation (assuming he had to undergo one), before being hired as a BART Police Officer.
It really is the ultimate outrage when a “peace officer” who is charged with protecting ALL PEOPLE cannot properly RESTRAIN HIMSELF, let alone the person who he is supposed to be subduing or taking into custody.
Mehserle needs to be held to account for his actions and at an even higher level (since he was a sworn officer) than the average person. He should be tried for Murder 1. Regardless of the outcome of any criminal trial, he should NEVER be allowed the use or possession of any firearm or weapon of any sort. Additionally, he should be made to pay a HEFTY fine.
I guess if I were Mehserle, I would probably use the gun on myself. I wouldn’t be able to live with myself if I had done what he did.

Poor Oscar – you totally didn’t deserve that. I’m a white father of 2 boys and quite frankly our police scare me stiff when I think of my kids going out and about – God only knows what it’s like for Black or Hispanic parents. Of course a person is going to resist when someone forces him to the ground and an a 200 lb man puts his knee on him – it hurts and they know it. What the hell was this moron doing in a police uniform? I saw no need to reach for weapon of any kind. This was just plain stupidity – how many more of these morons are out there?

I almost threw up the first time I watched this video.
1. Because of what happened in the video.
2. Because I voluntarily watched the video.
3. Because people so openly post this video online.
I can count the number of times I’ve vomited on my hands (including alcohol induced–two times) so I consider it a pretty big deal for me. I don’t want to digress too much so let’s leave it at that.
After I cleared my mind, I watched the video again and slowed it down (pressing the pause and play button fast) and have noticed many things.
The officer closest to the camera steps back and the one of the farthest to the right who doesn’t see what happens quickly reaches for his gun, looks to see what happens and steps really far back along with a handcuffed person. Then Johannes Mehserie, the one who discharged his firearm, looks down (probably at his gun or possibly at Oscar Grant). I also stopped the video where I could clearly see him gun-in-hand. From my perspective, I see doubt and denial in Johannes because of how he looks back down twice so quickly. Then the other officer gets down and shortly after so does Johannes and they move Oscar (which was not smart at all). I wish they rolled him over and then applied pressure to the wound while calling for an ambulance, but honestly I didn’t think he had much of a chance from such a close range shot.
Not doing too much research into the matter. I found out that Johannes resigned shortly after that day and he wrote a letter which I would hope would be included in the update to this story.

Saying that what he wrote is manure and a lie and what he did was premeditated murder is ludicrous. It’s a great example of a very unprepared LEO. I also have looked at many pictures of his face during his conviction on July 8th. That’s the look of guilt and shame.
I do not think that (note: think–I’m not entirely sure) you the right not to turn your phone over if it and/or you witnessed a crime. I think that’s why good cops confiscate evidence, because they want to help the case. Bad cops want to help their case, yes and evidence disappears. It’s crazy how 6,602 people die a day to Oscar Grant III was shot today.
I wonder if there’s coverage somewhere on the other 6,601 people that day.

I wonder if there’s coverage somewhere on the other 6,601 people that day and they were named.
I didn’t know that statistic –and that’s one from 2001 until today.
