I don't think a property owner can exactly make an enforceable order to you not to photograph something - the property owner (or agent) can exclude you from the property. So the owner or agent can say: If you take any more photographs I'm going to order you off the property. Or: I'm ordering you off the property.

If an airplane captain is anything like a ship captain, he/she has the power of life and death over all others...or something like that.

If it happens, it is truth..... WHAT is anyone afraid of? The truth of what really happened is WHAT we WANT to know.

She deserves an apology and much more for her persecution by this airline! Any place where the public is being processed or doing an activity, should be free for cameras and video taping....

"America - leaders of the Free World" - I don't think so.......... America has some of the most violent police in the world, has more than their share of corrupt politicians, still supports torture camps, and kills more people in wars than any other nation. Arresting people for taking photographs is the least of their problems. Not quite the definnition of "Freedom" that I was brought up to believe in.

I live on the edge of the city, and have a problem with feral rabits because people like to buy Easter Bunnies and then turn them loose when they realize how much work it is. I have 4 dogs that eat 42# of dog food a week so not small. They can clear a 6' fence with a running start and dig underneath if they have to to get at the rabbits.

So after talking with the local animal control I started shooting them with a peelet pistol and cleaning them for dog food. I was walking the neighborhood and plinking them whereever they happened to be.

Of course there was a woman who was giving them care and comfort which is of course where they all were hanging out. So one day while driving down they street there were several and so I stopped my truck got out and shot them. The woman was out and took offense to this to which I TOLD HER THEN STOP FEEDING THEM AND THEY MIGHT NOT ALL HANG AROUND HERE.

The next day I was driving down the street and as I approached the building she lived in this guy starts running down a drive waving to flg me down. I stop and open the passenger window and he tells me he is a Ak State Trooper and he heard that I was shooting rabbits. I said YES and? He told me that if he saw someone with a handgun that BAD SHIT WOULD HAPPEN!

I told him that bad shit would not happen until he determined if it was actually a firearm, (pellet gun is not under state law), as that was his training, he would not shot me or we would then be bowling for dollars. Then he says "Well if I was in uniform and someone is pointing a gun at me bad shit is going to happen and I don't know if......" My answer was of course IF I was pointing it at you that is a whole different story.

But I continued that the entire city including this street was a pink area (hunting legal, firearms in vehicle also legal, concealed weapon also legal here just so you know) and that these rabbits are going to die as they are causing trouble with my dogs. That further the utility easements are not private property so i am allowed to step out of my vehicle and step off the road and hunt. we went ion for awhile but you get the idea, I basically politely told him to mind his own business. He thought he was slick using his cell phone to take my picture, I asked when we were done if he needed me to pose for a picture, should have seen the look on his face he thought he was slick. On my way I went.

So I contacted Fish and Feather (also a division of AK state troopers, to verify that I was in compliance with the hunting regs and I am. However they told me that I needed to use a shotgun or bow and arrow. That trooper about flipped when I told him that I was going to have to switch to a shotgun or arrow!!!

I checked with the local cops and tey said that shotgun ws out of question in city limits, but that pellet gun was okay since it is not a firearm. Again I called fish and feather and they told me pellet gun ias okay and so as spring days arrive that I will be back out there plinking rabbits. I am also going to get a bow and arrow and get some practice with this mode of hunting as well as long as it is available to me as a hunter.

Now my point is this trooper was thinking he was going to use color of authority to cow me into making his neighbor lady happy!

Boy was he wrong and actually looked disappointed that I knew what I was talking about and not afraid to tell him so.

Yeah I suppose that is true depending on the state you live in, I forget that we here are afforded more right s as state citizens thatn the U S Constitution affords the staes in the lower 48.

For us at least;
Traffic signs on private property are just suggestions, traffic laws do not apply on private property. The only time you are required to obey traffic laws is if you happen to get a license from the state which then obligates you to follow the traffic laws. License is not required to operate a MV.

My dogs got out once and the lady down the street called the cops to tell me about it, When they arrived I told them fine, leave my property and closed the door in their face. They went away as instructed.

The Troopers tried that taffic saftey stop routine to stop vehicles along the berm lined up and then conduct interviews, they got to do it once and then people took them to task and they were told to stop harrassing citizens, the type of action was not legal and constituted fishing for evidence.

you need a warrent to go on or into private property

in short, no

for example, there's a legal concept called "immediate pursuit" (also called "fresh pursuit" or "hot pursuit") - police may enter private property in pursuit of a criminal - including breaking down doors, windows, etc. - no warrant needed

a Sears parking lot is a public place - we do not need a warrant or the owner's permission to enter the property for law enforcement purposes - doesn't matter if the owner summons us, a citizen summons us, or we see something going down - doesn't matter if the crime is a felony, misdemeanor or infraction - same for the store itself, public place

think about this a sec - a robbery is going down, the getaway car is idling in the parking lot - do you really think permission has to be obtained to enter the property?

of course citations can be issued for actions on private property - if you run a stop sign at the shopping mall on their little private roads, you can be cited by a police officer without the property owner's knowledge or permission - your state's vehicle codes enables this - it's the use of the motor vehicle that triggers what's legally known as "state interest" not whether the event occurs on private property or not

search warrants are needed for most searches, an arrest warrant is needed for a misdemeanor not witnessed by a police officer (not necessary for a felony though)

Officer Brad, much case law, which we know helps modify and qualify judicial isssues related to the enforcment of a statute. Felony crimes vs. misdemeanor makes the difference, If a person disappears and no matter what you think, without direct visualization of evidence, you need a warrent to go on or into private property (emergent need to secure evidence from destruction may help justify entry, but that is a slippery slope)

Private vs. Public - Easiest example is that of a rear ender in a parking lot at Sears, Police may or may not take a report but cannot issue a citation as the property is private, its actually a gray area as the law may recognize the parking lot as a Quasi-public as the store owns it but people(general public) is allowed to use it. If invited on and asked to enforce say trespassing, shoplifting etc., Police become mearly a reporting and transportation service based on the request of the owner. Charges are pending the owner's filing them.

I am on my way out but will post a story later or tomorrow about my experience with the AK State Trooper down the block from me. You'll love it (its the famous Alaska Troopergate Trooper).

I don't think anybody is bound by Miranda. That is just a myth but it makes for good 1970s cop shows.

the police have no powers of investigation on private property

really? so like if a homicide is committed on private property, the police can't investigate?

you have any kind of statutory cite for this?

Jeff that is correct, however it is Private Property and the police have no powers of investigation on private property, that is why the malls and such have thier own Stazi Police. The private Stazi Police are not bound by the same tenants as the Police they can take statements and then use the information against you. They are not bound by Miranda, nor any other Constitutional tenant. They can beat a cofession out of you and then turn you over to the Police and use your confession againstr you in a court of law.
